General Terms and Conditions and Privacy Policy for MagicCon Amsterdam (17-19 July 2026) of Sammelkartenmarkt GmbH & Co. KG (Cardmarket)
§ 1 Organizer and Scope
(1) These terms and conditions of participation and data protection information govern the participation in the activities – namely Mystery Swap, Raffle, Community Battles, Helpdesk – offered at the booth of Sammelkartenmarkt GmbH & Co. KG, Nordkapstr. 4, 10439 Berlin (hereinafter referred to as the "Organizer") during the trade fair “MagicCon Amsterdam” (17-19 July 2026 at RAI Amsterdam, Europaplein 24, 1078 GZ Amsterdam), as well as the collection and use of data collected from or communicated by participants.
(2) By participating in the competition participants accept these conditions of participation.
§ 2 Conditions of Participation
(1) Participation is open only to natural persons aged eighteen (18) years or older. Certain activities require a registered user account on www.cardmarket.com. Such an account can be opened free of charge at www.cardmarket.com. Excluded from participation are accounts held by employees of the organizer as well as employees of cooperation partners who are or were involved in the creation or execution of the trade fair.
(2) Participation is limited to one (1) participation per person, per day, per account, except for Helpdesk and Community Battles. Participation, when a user account is required, must be made using an account registered in the participant’s own name. Participation is free of charge.
(3) The activities take place exclusively at the organizer’s booth at Hall 1, Booth Number 1500 at MagicCon Amsterdam on 17-19 July 2026. The participation period runs from: 17-18 July 2026, 8:30-19:00 (UTC+2) and 19 July 2026, 8:30-18:00 (UTC+2). The organizer reserves the right to adjust the period for justified reasons (e.g. operational, safety).
(4) Participants must comply with instruction from booth staff at all times.
(5) The organizer may exclude participants who provide incorrect information, violate these terms, disrupt the activity, attempt manipulation, or otherwise jeopardize the proper conduct of the activities.
§ 3 Activities
(1) Mystery Swap requires an active Cardmarket user account and a trading card to swap in. The participant provides a trading card with a value between 1,00 EUR and 50,00 EUR. The participant and a staff member of the organizer will check the average value of the trading card together on www.cardmarket.com. The participant hands over the property of the card to the organizer. In return, the participant selects one card from the designated Mystery Box, matching the rough value of the swapped card. If the value does not match, the organizer will supplement the received card value with an additional item, e.g. a Cardmarket coupon, redeemable within three months for the marketplace of the organizer or a Booster Pack. While the organizer aims to avoid value disadvantages, no exact value equivalence can be guaranteed. The participant acknowledges that valuation differences may occur. The card must be authentic and original, legally owned by the participant, be in a suitable condition and free from third-party rights. The organizer reserves the right to refuse the card if it does not fit the purpose of the activity. All swaps are final and binding. Returns, exchanges, or monetary compensations in total are excluded. The Mystery Swap is not a purchase, game of chance, appraisal, or brokerage service. The Mystery Swap is solely for entertainment purposes and does not depend on luck or chance.
(2) Raffle requires an active Cardmarket user account. The participant receives a numbered ticket which must be retained until the raffle announcement at the end of every day at 16:30-17:00 (UTC+2). Winners will be selected randomly if their number is drawn. The participant must be present at the announced raffle winner ceremony (end of every day at 16:30-17:00 (UTC+2)). If the participant’s ticket gets drawn, but the participant does not react in a timely manner, is absent or cannot present their valid raffle ticket, a new winner will not be drawn and the prize is forfeited. Prizes are non-transferable and cannot be exchanged or paid out in cash or other valuable items.
(3) Community Battles provide an informal space where visitors may play the trading card game “Magic: The Gathering” with Cardmarket employees and influencers. Community Battles are purely recreational and noncompetitive. There is no entitlement to a game or a game against a specific person. No prizes, ranking, or official tournament structures apply. Participants are responsible for their own materials such as trading cards and accessories. The organizer assumes no liability for loss or damage of personal property in this context.
(4) Helpdesk allows visitors to speak directly to Cardmarket Customer Support representatives. The support agent can give general guidance, assistance in creating support tickets, and explanation of policies and processes. Resolution of ongoing or existing support cases, binding decisions, or claim determinations are explicitly excluded. Formal complaints or the trigger of legal deadlines are excluded. All official support interactions remain subject to the organizer’s standard processes. The Helpdesk is solely of informal character.
§ 4 Data Protection
(1) Personal data is processed for the purpose of conducting the activities and for statistical and analytical purposes, such as to improve the user product discovery. Data collected may include the username, user-ID, full, name, and/or contact details of the natural person. The participant gives explicit consent for processing their data. Legal basis for that purpose is Art. 6 (1) lit. a, b GDPR. Data will be deleted after completion of the activities unless legal retention obligations apply. In the case of processing for statistical and analytical purposes, personal data will be stored only for as long as necessary for the purposes set out in 4(2). To the extent possible, the organizer will process such data in a pseudonymized form and will anonymize or delete the data once individual identification is no longer required. Analyses may therefore be performed using only the participant’s user ID, username or other pseudonymized identifiers. The organizer’s privacy policy applies (www.cardmarket.com/privacypolicy).
(2) Personal data may furthermore be used for statistical and analytical purposes in order to evaluate and improve the organizer’s products, services, user acquisition and retention strategies, marketing activities and event-related campaigns. Such analyses may be conducted on an individual or aggregated basis and may be used to assess the success of marketing and customer engagement initiatives.
(3) Participants give their consent to be named and/or be visible in social media posts or on the website of the organizer.
§ 5 Liability
(1) The following exclusions and limitations of liability shall apply to the liability of the organizer for damages, irrespective of the other legal requirements for claims.
(2) The organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
(3) The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
(4) Insofar as the liability of the organizer is excluded or limited, this shall also apply to the personal liability of employees, representatives, and vicarious agents of the organizer.
§ 6 Other
(1) These terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Berlin, Germany.
(2) The activities may be terminated or removed due to internal or external circumstances and constraints, without this giving rise to any claims by participants against the organizer. The organizer reserves the right to change the conditions of participation at any time.
(3) The activities are in no way sponsored, endorsed, administered by, or associated with MagicCon Amsterdam, its organizer or associated partners, or Magic: The Gathering, its manufacturer, or associated partners.
